Terms of Use

1. About these terms

My Diet Bot (the iPhone app and mydietbot.com) is provided by Furkan Kesen, an individual developer based in Hamburg, Germany (“we”, “us”, “our”). By creating an account or using My Diet Bot, you agree to these Terms of Use and acknowledge our Privacy Policy. If you don't agree, please don't use My Diet Bot.

2. Who can use My Diet Bot

• You must be at least 18 years old and able to enter into a binding contract.
• Your account is for you alone. Give accurate information and keep your sign-in details secure.
• Tell us promptly at support@mydietbot.com if you think someone else has accessed your account.
• You may not use My Diet Bot if the law prohibits you from doing so.

3. Health information, not medical advice

• Calorie, macro and other estimates are generated by AI and may be inaccurate or incomplete. Calorie targets are general estimates from standard formulas and don't account for your full medical situation.
• Nothing in My Diet Bot is medical advice, and it's not a substitute for a doctor or registered dietitian.
• Talk to your doctor before changing your diet, especially if you're pregnant or breastfeeding, have a medical condition (such as diabetes, or heart or kidney disease), take medication, or have a history of disordered eating.
• Never ignore or delay professional medical advice because of something you read in the app.
• If you have a food allergy, always check ingredients and labels yourself. My Diet Bot can't guarantee that a food is safe for you.
• My Diet Bot is not an emergency service. If you're in crisis, think you might harm yourself, or have a medical emergency, contact your local emergency services immediately.

4. AI features

Coach replies, meal estimates, voice-note transcription and read-aloud use AI models provided by OpenAI, and they only run after you give permission in the app. AI output can be wrong, incomplete or not right for you, so review estimates before logging them and use your own judgment. 5. Your content

You keep ownership of everything you add to My Diet Bot, such as messages, meal photos, voice notes and profile details (“your content”).

You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display your content only as needed to operate and provide My Diet Bot to you, including sending it to our service providers as described in the Privacy Policy, and to keep the service secure. This licence ends when you delete the content or your account, except for copies in backups, which are removed within 30 days.

We don't use your content to train AI models, we don't use it for advertising, and we don't sell it. Replies and estimates generated for you are yours to use personally. You confirm that you have the right to share whatever you upload.

6. Acceptable use

When you use My Diet Bot, please don't:

• break the law, or help anyone else to;
• upload content that is illegal, sexually explicit, hateful or harassing, or that infringes anyone's rights, including photos of other people without their permission;
• try to access other people's accounts or data, probe or breach our security, or disrupt the service;
• reverse engineer, scrape or copy the service, except where the law allows it;
• use bots or other automated means, send excessive requests, or try to get around usage limits;
• resell or commercially exploit the service, or use it to build a competing product;
• use it to create content meant to harm yourself or others;
• impersonate anyone or misrepresent who you are.

To keep My Diet Bot reliable, we may apply reasonable usage limits, for example a daily number of AI requests.

7. Changes and availability

We're always improving My Diet Bot, so features may be added, changed or removed. We aim to keep it available but can't promise it will always be uninterrupted or error-free. If a change significantly affects you, we'll try to tell you in advance. If we ever introduce paid features, we'll tell you clearly before you pay, and the terms shown at the time of purchase will apply.

8. Ending your account

You can stop using My Diet Bot and delete your account at any time in Settings. Here's how.

We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or to protect other users or the service. Where appropriate, we'll tell you why and give you a chance to respond. If we ever discontinue My Diet Bot, we'll give you reasonable notice and a chance to get a copy of your data. When an account is closed, its data is deleted as described in the Privacy Policy.

9. Disclaimers

My Diet Bot is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including about accuracy, fitness for a particular purpose, or that the service will be error-free. If you're a consumer, you have legal rights in your country that these terms don't affect, including any statutory guarantees.

10. Limitation of liability

To the extent the law allows, we're not liable for indirect, incidental, special or consequential losses, or for loss of data, profits or goodwill, arising from your use of My Diet Bot. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim, or EUR 50.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.

11. Apple App Store terms

If you downloaded My Diet Bot from Apple's App Store, these additional terms apply:

• These terms are between you and us, not Apple. Apple isn't responsible for My Diet Bot or its content.
• Your licence to use the app is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you can notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• Apple isn't responsible for any claims relating to the app or your use of it, including product liability claims, claims that it fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws. We are responsible for these as set out in these terms.
• If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
• You confirm that you're not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you're not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms, such as your mobile data agreement, when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.

12. Changes to these terms

We may update these terms from time to time and will update the date and version at the top. For significant changes, we'll tell you in the app or by email at least 30 days before they take effect, unless a change is required sooner by law or for security. If you keep using My Diet Bot after changes take effect, the updated terms apply. If you don't agree, you can delete your account.

13. Governing law and disputes

These terms are governed by the laws of the Federal Republic of Germany. If you're a consumer, you also keep the protection of any mandatory laws of the country where you live, and you can bring a claim in the courts where you live. Before starting a formal dispute, please contact us at support@mydietbot.com so we can try to resolve it informally.

14. General

If any part of these terms is found to be unenforceable, the rest stays in effect. If we don't enforce a right straight away, we don't give it up. You can't transfer your rights under these terms without our agreement. We may transfer ours as part of a reorganisation or sale of My Diet Bot, as long as your rights aren't reduced. These terms and the Privacy Policy are the whole agreement between you and us about My Diet Bot.
